It is your responsibility to periodically review this Agreement to stay informed of updates. Your use of this Site constitutes acceptance of this Agreement. IF YOU DO NOT AGREE WITH THIS AGREEMENT, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Under no circumstances will you acquire any ownership rights or other interest in any content by or through your use of this Site.

5. Site Use. Fiancee grants you a limited, revocable, nonexclusive license to use this Site solely for your personal, non-commercial use in connection with browsing, shopping for, and purchasing products offered on the Site. You may not use the Site for republication, distribution, assignment, sublicense, sale, preparation of derivative works, or other unauthorized use. You agree not to copy content from the Site, reverse engineer or hack into the Site, or use materials, products or services in violation of any law. Your use of this Site is at the discretion of Fiancee who may terminate your access and use at any time.

6. User Accounts and Registration.  You may be required to register with the Site to access certain features. You agree to keep your password confidential and will be responsible for all use of your account and password. You agree that all information you provide during registration and thereafter will be true, accurate, current, and complete, and you will promptly update such information as necessary. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable. We reserve the right to suspend or terminate your account and refuse any and all current or future use of the Site if any information you provide is untrue, inaccurate, not current, or incomplete. You agree to indemnify, defend, and hold harmless Fiancee, its affiliates, officers, directors, employees, agents, service providers, and contractors (collectively, the "Indemnified Parties") from and against any and all claims, liabilities, losses, damages, judgments, awards, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your violation of this Agreement; (b) your use or misuse of the Site or any content made available through it; or (c) any violation of applicable law or the rights of a third party. The Indemnified Parties shall have the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate fully in such defense.

12. Disclaimer. The use of this Site is at your sole risk. The Website and any information or service provided through the Site is provided on an “as is” and “as available” basis. FIANCEE EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 15. Third-Party Services and Payment Processors.

Your use of these third-party services is subject to the terms and conditions of those respective providers. We are not responsible for the content, privacy policies, or practices of any third-party service. By using the Site and making purchases, you acknowledge that certain personal and transactional information may be shared with these third-party providers as necessary to process your orders and provide our services. In particular, if you elect to use a buy-now-pay-later service (such as Klarna, Afterpay, or Affirm), any dispute relating to the financing terms, installment payments, or late fees shall be between you and that provider.

16. Applicable Law. You agree that the laws of the state of Connecticut without regard to conflicts of laws provisions will govern this Agreement and any dispute that may arise between you and Fiancee or its affiliates. Venue shall be the state and federal courts located in the State of Connecticut. YOU AGREE THAT REGARDLESS OF ANY STATUTE OR LAW TO THE CONTRARY, ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SITE, ANY SERVICE PROVIDED BY THE SITE, OR THE TERMS OF USE MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE OR BE FOREVER BARRED.

17. Severability. If any provision of this Agreement shall be adjudged by any court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect.

18. No Waiver. Our failure to enforce any right or provision of this Agreement will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative. Except as expressly set forth in this Agreement, the exercise by either party of any of its remedies under this Agreement will be without prejudice to its other remedies under this Agreement or otherwise.

19. Assignment.  We may assign or transfer this Agreement and our rights and obligations hereunder, in whole or in part, in connection with a merger, acquisition, sale of assets, reorganization, or change of control, or to an affiliate, without your consent or notice. You may not assign your rights or obligations under this Agreement without our prior written consent.

20. Entire Agreement.  This Agreement, together with our Privacy Policy, Terms of Sale, Return and Exchange Policy, Warranty Policy, Custom Purchase Policy, and any other policies or terms referenced herein or posted on the Site, constitutes the sole and entire agreement between you and Fiancee regarding the Site and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.
